1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between MW Apartment GmbH (“Company,” “we,” “us,” “our”) and you (“User,” “you,” “your”) regarding your use of our website www.agwalgram.com and the services we provide.

By accessing, browsing, or using our website and booking services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Description of Services

MW Apartment GmbH operates a luxury chalet rental platform offering high-end Alpine residences located in Austria. We facilitate the connection between property owners/managers and guests seeking luxury accommodation in the Austrian Alps. We do not own or operate the properties listed on our platform.

3. User Responsibilities

You agree to:

  • Provide accurate, current, and complete information when making a booking
  • Use the website and services only for lawful purposes
  • Not engage in conduct that restricts or inhibits anyone’s use or enjoyment of the website
  • Not harass, abuse, or threaten other users or staff
  • Not attempt to gain unauthorized access to restricted areas

4. Booking & Reservation Process

Quote-Based Booking: Our booking process operates on a quote system. When you submit a booking inquiry:

  • You are requesting a quote for your desired dates and property
  • Submission of an inquiry does not constitute a confirmed booking
  • We will review your request and send you a formal quote via email within 24 hours
  • A booking is only confirmed upon receipt of the deposit and signed booking conditions

5. Pricing & Payment

All prices are quoted in Austrian Francs (EUR) and are subject to change without notice. Prices do not include:

  • Optional services (private chef, concierge, activities)
  • Local taxes or VAT where applicable
  • Travel or cancellation insurance

Payment Terms: A deposit of 30% (or as specified in your quote) is required to secure the booking. The remaining balance is due 4 weeks prior to arrival. We accept bank transfers. Payment must be made in Austrian Francs (EUR).

6. Cancellation & Refund Policy

Cancellation policies vary by property and season. Standard policy:

  • 60+ days before arrival: Deposit is refunded minus 10% administrative fee
  • 30-59 days before arrival: 50% of total booking amount is refunded
  • 14-29 days before arrival: 25% of total booking amount is refunded
  • Less than 14 days: No refund provided

Specific cancellation terms will be provided in your booking confirmation. Force majeure events may affect these terms.

7. Property Descriptions & Images

We strive to provide accurate descriptions and images of our properties. However:

  • Images are representative and subject to lighting and photographic conditions
  • Seasonal changes may affect property appearance and amenities
  • We are not responsible for minor variations in furnishings or décor
  • Property availability and amenities are subject to change

8. Guest Conduct & Liability

Guests are responsible for:

  • Following all property rules and local laws
  • Any damage caused to the property during their stay
  • Complying with noise restrictions and neighborhood guidelines
  • Respecting the property’s furnishings and equipment

The Company is not liable for injuries, accidents, or property damage that occur during your stay, except where liability cannot be excluded by law.

9. Limitation of Liability

To the fullest extent permitted by law, MW Apartment GmbH shall not be liable for:

  • Direct, indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business interruption
  • Inability to use the website or services
  • Third-party conduct or property owner actions

10. Intellectual Property

All content on our website, including text, images, designs, and logos, is the property of MW Apartment GmbH or its licensors. You may not reproduce, distribute, or transmit any content without written permission.

11. Governing Law

These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the court competent for Wien.

Where the guest is a consumer resident in the European Union, this choice of law does not deprive the guest of the protection of mandatory consumer provisions of the law of their country of residence, and the guest may also bring proceedings in the courts of that country.

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting to the website. Your continued use of our services constitutes acceptance of modified Terms.
